These Terms of Use ("Terms") apply to your use of the BatNote website and the BatNote mobile application ("BatNote", "we", "our" or "us"). By accessing or using BatNote, you agree to these Terms.

If you download BatNote via the Apple App Store, your use is also subject to Apple’s terms and policies. If there is a conflict between these Terms and the App Store terms, the App Store terms may apply where required.

About BatNote

BatNote is a field-first iOS application designed to help ecological professionals record bat survey observations and generate structured survey reports. BatNote does not provide ecological consultancy advice and does not replace professional judgment.

Eligibility

You must be at least 16 years old to use BatNote. BatNote is intended for professional or responsible use. If you use BatNote on behalf of an organisation, you confirm you have authority to accept these Terms on its behalf.

Your data and responsibility

You are responsible for the accuracy, completeness and legality of the information you enter into BatNote. You are also responsible for how you use any outputs generated by BatNote, including PDF reports.

BatNote is designed to store survey data locally on your device. You are responsible for maintaining appropriate backups and safeguarding your device, including using device security features (e.g. passcode, biometrics).

Report exports and professional use

BatNote may generate reports based on your inputs and device-provided data (such as location, time, map display and weather information). Reports are generated for convenience and documentation support.

You acknowledge that ecological surveying and reporting requires professional competence. You must review and verify all exported reports before using them for official submissions, clients, planning applications or regulatory purposes.

Purchases and credits

BatNote may offer optional in-app purchases such as report export credits. Purchases made through the App Store are processed by Apple and are subject to Apple’s purchase terms, including billing, refunds and cancellations.

Unless required by law or explicitly stated, purchased credits are non-transferable and non-refundable once granted to your account. If you experience a purchase issue, please contact Apple Support for billing requests.

Acceptable use

You agree not to misuse BatNote. This includes, but is not limited to:

attempting to reverse engineer, decompile or extract source code where not permitted by law
attempting to bypass security, rate limits or paywalls
using BatNote for unlawful activities
interfering with the normal operation of the website or app

Intellectual property

BatNote and all associated branding, designs, software and content are owned by BatNote Ltd or its licensors. You may not copy, modify or distribute BatNote materials except as permitted by law or with our written permission.

You retain ownership of the content and data you create in BatNote. These Terms do not grant BatNote any ownership rights over your survey content.

Availability and changes

We may update, change, suspend or discontinue BatNote (or any part of it) at any time. We aim to keep BatNote available and reliable, but we do not guarantee uninterrupted operation.

Disclaimers

BatNote is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose and non-infringement.

Limitation of liability

To the extent permitted by law, BatNote Ltd will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, data, business or goodwill arising out of or in connection with your use of BatNote.

Nothing in these Terms limits liability where it cannot be excluded under applicable law (for example, liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation).

Governing law

These Terms are governed by the laws of England and Wales. Courts of England and Wales will have exclusive jurisdiction over disputes relating to these Terms, except where consumer law requires otherwise.
